Bail Granted in Serious Offence Under Section 307 IPC

In a significant order dated 6th October 2023, the Hon’ble High Court of Madhya Pradesh at Gwalior granted bail to the applicant Golu, represented by Advocate Sourav Singh Tomar, in MCRC No. 43362 of 2023. The case was registered at Police Station Gole Ka Mandir, District Gwalior, under Section 307 of the IPC—attempt to murder—a grave and non-bailable offence. The FIR alleged that the applicant had assaulted the complainant with the intent to cause death, resulting in serious injuries.

Advocate Sourav Singh Tomar meticulously argued that the applicant had been falsely implicated and that the injuries sustained, although serious, were not life-threatening or fatal in nature. He further pointed out the applicant’s clean record, cooperation with the investigation, and the fact that the recovery had already been made. Emphasizing the principles of bail jurisprudence and the fundamental right to liberty under Article 21 of the Constitution, he successfully persuaded the Court that continued incarceration would serve no further purpose.

The Hon’ble Court, after considering the facts, medical records, and arguments presented, found merit in the defence and granted bail upon furnishing a personal bond with surety. The Court imposed appropriate conditions to ensure that the applicant remains compliant with trial proceedings and does not interfere with witnesses or the investigation.
