Bail Granted in Serious Offences Under BNS 2023:

In a notable order passed by the Hon’ble High Court of Madhya Pradesh at Gwalior on 18th October 2024, Advocate Sourav Singh Tomar successfully secured bail for his client, Pahalwan @ Alwan Singh, in connection with Crime No. 133/2024, registered at Police Station Maksudangarh, District Guna (M.P.). The case involved serious charges under Sections 109(1), 310(2), 311, 191(2), 191(3), and 190 of the Bharatiya Nyaya Sanhita, 2023. The client had been in custody since 07.07.2024, and his first bail application was earlier withdrawn with liberty to reapply after the filing of the charge sheet.

Advocate Sourav Singh Tomar, appearing for the applicant, effectively argued that the applicant had been falsely implicated and that post-filing of the charge sheet, no further custodial interrogation was required. He emphasized the non-fatal nature of the injuries involved and pointed to the fact that the co-accused, Mahendra Sahu, had already been granted bail in a parallel proceeding. Stressing parity and compliance with procedural safeguards, Advocate Tomar demonstrated that his client posed no risk of absconding or tampering with evidence and was a permanent resident of District Guna.

After hearing arguments and perusing the case diary, the Hon’ble Justice Sunita Yadav allowed the second bail application and directed that the applicant be released on bail upon furnishing a personal bond of ₹50,000 with two solvent sureties. The court imposed strict compliance conditions, including regular attendance at the police station and non-interference with the ongoing trial.

This case reflects Advocate Sourav Singh Tomar’s sharp legal acumen and strategic litigation approach in securing relief in sensitive and complex criminal cases. His dedication to ensuring fair treatment under the law and ability to draw favorable comparisons with co-accused bail precedents underscores the growing reputation of TMS Law Associates as a leading law firm in Madhya Pradesh High Court and beyond.
