Successful Anticipatory Bail Secured by Advocate Sourav Singh Tomar in M.P. Excise Act Case – MCRC No. 13232/2024

In a significant legal victory, Advocate Sourav Singh Tomar, founder of TMS Law Associates, successfully secured anticipatory bail for his client, Kuldeep S/o Shri Mansingh, in a case registered under Section 34(2) of the M.P. Excise Act and Sections 3/181 and 5/180 of the Motor Vehicles Act. The case, arising out of Crime No. 411/2021 at Police Station Dharnavada, District Guna, involved allegations of the illegal transportation of 155 litres of liquor. The applicant was implicated based solely on the disclosure statement of a co-accused recorded under Section 27 of the Indian Evidence Act—without any direct recovery or independent evidence against him.

Advocate Tomar appeared before the Hon’ble High Court of Madhya Pradesh at Gwalior in Misc. Criminal Case No. 13232 of 2024 and argued that the applicant was falsely implicated and that no prima facie case was made out. He highlighted that the co-accused, Arvind and Banwari, had already been granted anticipatory bail by the Court in a similar matter (MCRC No. 60114/2022 dated 20.01.2023), thus establishing parity in the facts and circumstances. The Hon’ble Mr. Justice Rohit Arya, after hearing both sides, agreed with the contention and granted anticipatory bail to the applicant, directing his release upon furnishing a personal bond of ₹2,00,000 with two solvent sureties. The applicant was also directed to mark attendance twice a month at the concerned police station and comply with other statutory conditions under Section 438(2) CrPC.

This order underscores Advocate Sourav Singh Tomar’s expertise in criminal defence and bail jurisprudence. His well-reasoned legal strategy and persuasive advocacy ensured that the liberty of an innocent person was protected against arbitrary arrest. The case stands as another testament to his commitment to justice and client-focused legal practice. TMS Law Associates continues to represent clients with diligence and distinction before the High Court of Madhya Pradesh and the Supreme Court of India.
